1. Seller information

LA VALLE SRL AGRICULTURAL COMPANY SINGLE-MEMBER COMPANY
Tabiano 21 – 43036 Fidenza (PR), Italy
VAT Number and Tax Code: 04570710964
Email: reservation@originecountryfarm.it
Website: originecountryfarm.it

Hereinafter referred to as “Origine Country Farm” or the “Seller”.

2. Object and scope of application

These general conditions govern the remote sale, through the website originecountryfarm.it, of experiences and activities, stays, and gift cards offered by Origine Country Farm. By placing an order, the customer declares to have read and accepted these conditions in the version published at the time of purchase.

When the customer acts for purposes unrelated to their business or professional activity, the protections provided by the Consumer Code (Legislative Decree 206/2005) also apply.

3. Products and services

The essential characteristics of each experience, activity, or stay — duration, content, number of participants, and any requirements — are indicated in the relevant product sheet. The published images and descriptions are for illustrative purposes only and do not constitute a guarantee of exact correspondence.

Some activities take place outdoors and in the presence of animals: their execution may depend on weather conditions, the welfare and availability of the animals, and the achievement of a minimum number of participants.

4. Prices

All prices are in euros and inclusive of VAT where applicable. The applicable price is the one displayed on the website at the time the order is transmitted. Any additional costs, if applicable, are indicated before order confirmation.

5. Conclusion of the contract

Submitting the order via the website constitutes a purchase offer. The contract is deemed concluded when the Seller sends the order confirmation to the customer at the email address provided. The Seller reserves the right not to accept incomplete or incorrectly filled-out orders, or those relating to services that are no longer available, promptly notifying the customer.

The customer is responsible for the accuracy of the data provided, in particular the email address to which confirmations and documents are sent.

6. Payment method

The payment methods indicated during the order process are accepted, which currently include credit or debit card (also via Apple Pay and Google Pay), Klarna, bank transfer, and payment at the property.

In case of payment by bank transfer, the order remains on hold until the funds are credited: the reservation and any issuance of the gift card take place only after verification of the payment received.

7. Gift card

  • The gift card is issued in PDF format and sent to the email address provided at the time of purchase, after payment verification.
  • Each gift card displays a unique identification code and the expiration date.
  • The validity is 6 months from the issue date, as indicated on the card itself.
  • The ransom takes place exclusively at the facility, upon prior reservation and presentation of the code. The gift card does not generate discount codes or balances that can be used online.
  • The gift card is registered as used upon redemption.
  • The gift card cannot be converted into cash, is not reloadable, and does not entitle the holder to cash change.
  • After the expiration date, the gift card is no longer usable and the amount is non-refundable, barring any statutory provisions to the contrary.
  • In case of loss of the PDF, the code remains valid: it is sufficient to contact the facility to obtain a copy.

8. Reservations, Changes, and Cancellations

The date and time of the experiences and stays are agreed upon with the property. The applicable modification and cancellation conditions are those indicated in the purchased product sheet and in the booking confirmation.

The Seller may reschedule or cancel an activity for safety reasons, due to adverse weather conditions, unavailability of the animals, or for reasons of force majeure. In such cases, the customer will be offered an alternative date or, if this is not feasible, a refund of the amount paid for the activity not performed.

9. Right of withdrawal

Generally speaking, the consumer has the right to withdraw from distance contracts within 14 days, pursuant to Articles 52 et seq. of the Consumer Code.

This right does not apply, pursuant to Article 59, paragraph 1, letter n) of the Consumer Code, to contracts relating to accommodation services for non-residential purposes, catering, and leisure activities when the contract provides for a specific date or period of execution. Experiences, activities, and stays booked for a specific date fall under this exclusion.

The right of withdrawal applies instead to the purchase of gift cards not yet redeemed and not referring to a specific date. To exercise it, it is sufficient to send an explicit communication within 14 days of receiving the gift card to reservation@originecountryfarm.it, indicating the order and card code. The refund is made using the same payment method used for the purchase, at no additional cost.

10. Customer obligations and safety

Horseback riding, animal-assisted, and outdoor activities involve risks that cannot be entirely eliminated. By purchasing and participating, the customer agrees to:

  • declare one's psycho-physical fitness to carry out the booked activity and report in advance any relevant health conditions, pregnancy, allergies, or ongoing therapies;
  • accurately state one's level of experience, particularly for equestrian activities;
  • strictly follow the staff instructions and use the specified clothing and protective equipment, including the helmet where required;
  • do not participate under the influence of alcohol or drugs;
  • supervise minors, who must be accompanied by a responsible adult.

Staff may exclude from participation, at any time, anyone who does not respect the instructions or safety rules or has provided untrue statements; in such cases, no refund will be provided.

The serving of alcoholic beverages, where provided for by acquired experience, is reserved for those over 18 years of age.

11. Liability

The Seller is liable for damages arising from the failure or incorrect execution of its obligations within the limits provided by law. The Seller is not liable for damages arising from the non-observance of instructions given, untruthful statements by the customer, reckless behavior of the participant, nor for fortuitous events or force majeure.

Nothing in these terms limits or excludes the Seller's liability in cases where such limitation or exclusion is not permitted by law, specifically for intentional misconduct or gross negligence and for personal injury.

12. Complaints and assistance

Any complaints may be submitted to reservation@originecountryfarm.it. The Seller undertakes to respond within a reasonable time upon receipt.

13. Dispute Resolution

The consumer customer may optionally and without prejudice to the right to resort to the judicial authority, resort to alternative dispute resolution bodies registered in the lists kept by the competent authorities, including the conciliation services established at the Chambers of Commerce.

14. Applicable Law and Jurisdiction

These terms and conditions are governed by Italian law. For disputes with a consumer customer, the court of the place of residence or elected domicile of the consumer shall have mandatory jurisdiction, pursuant to Article 66-bis of the Consumer Code. For relations with customers who do not qualify as consumers, the court of Parma shall have exclusive jurisdiction.

15. Processing of personal data

The processing of customers' personal data is described in the Privacy Policy and in the Cookie Policy of the site.

16. Changes to the terms

The Seller reserves the right to modify these general terms and conditions at any time. Sales already concluded shall be governed by the version of the terms and conditions published on the website at the time the order was transmitted.
